Frequently Asked Questions

My son is seriously disabled but I can’t get the help I need from social services. What can you do to help?

We can use the law to get your son’s care needs assessed – and yours too as a carer. Then, depending on how important they are to him the authority can be made to provide what is needed.

I need special adaptations for my husband at home. Can you help us?

Yes, the law provides for this, and there are grants available in some circumstances.

Social Services have spent over a year assessing our son’s care needs. What can you do to get the care provision he needs?

A Care Plan should be drawn up once the needs have been assessed. It can then be changed, but the authority should reach this stage and finish the assessment. We can assist to make sure this is done.

Is it the NHS Trust or Social Services – who is responsible?

There are often battles over who provides the funds, but it is social services responsibility to make sure that care needs are met. Critical needs must be met but less important needs may not be depending on the local authority. We can advise and take Court action if needs be.

I want my husband to care for me, but they won’t pay for him if he gives up work. What are my rights?

You have rights under the European Convention. We can help you enforce them. Get in touch – we have already changed the law on this point by Court action.

When I came out of hospital I never got the care I should have received. Can I claim damages?

Yes. How far we can go with a claim depends on the facts, as Legal Aid isn’t available unless the likely level of damages is worth the costs incurred.
