Frequently Asked Questions

I am deeply in debt with rent arrears and I am being evicted next week. Can you keep me in my home?

We can apply to the Court to stop the eviction and for time to sort out the rent arrears. Maybe housing benefit needs chasing up. Get in touch with us immediately if you already have a Court hearing date. Don’t wait!

Our home is damp and there’s black mould. The children are always ill and have bad asthma. What can you do to help us?

We have brought hundreds of disrepair claims to get repairs done and to claim damages. Contact us.

The Council says I have been causing a nuisance but it’s me who has been harassed. I’m in court soon. Will you represent me?

Yes we can represent you but let us know straight away when you are in court. Don’t delay getting an appointment.

They’ve slapped an ASBO on my son and now they are trying to evict me. What can I do?

It doesn’t automatically follow that you should lose your home. What we can do depends what stage things are at. Get in touch for advice – and if you have got Court papers already ask for an urgent appointment and let us see the papers. Make sure we know when any court hearing has been set.

I’ve lived here all my life and now my father has died. I’m told I have to leave my home. What are my rights?

You probably have a right to stay where you are. But we need to know more. Get in touch.

I have lived here for 10 years as a Council tenant but when I applied for ‘Right to Buy’ I am told we’re not tenants and I have no rights. Why?

The most likely reason is that a suspended possession order was made some time in the past and you didn’t keep to the conditions. We will need to apply to Court to re-instate your tenancy.

The landlord says if we’re not out by the weekend he’ll throw us and all our things out into the street. Can you get an emergency Court order?

Harassment and unlawful eviction are both against the law – and are criminal offences. If your landlord won’t respond to reason we may need to get an injunction from the Court. Contact us urgently.

They say it is my fault I am homeless. Can you do something for me?

We can appeal a decision of ‘intentional homelessness’. There are time limits, so contact us quickly.

I’ve had priority for a house for a year now and we’re overcrowded. How can we get moved?

We need to check the details and make sure you have the correct level of priority. We can advise on the local authority’s allocation scheme.
